Liability for content

In accordance with general law in accordance with s. 7, para. 1, German Telemedia Act (TMG), we can be held liable for our own content on these pages. We only process your personal data (hereinafter mostly referred to as "data") to the extent that this is necessary in order to provide a functional and user-friendly website, together with its content and the services offered there.

In accordance with Art. 4, sub-section 1 of Regulation (EU) 2016/679, that is, the General Data Protection Regulation (referred to below as “GDPR”), “processing” shall be deemed to be all steps carried out with or without the help of automated processes or any such series of processes in connection with personal data, such as the collecting, recording, organizing, arranging, storing, adapting or changing, reading, querying, using, disclosing through transmission, dissemination or any other form of provision, comparison or linking, limitation, deletion or destruction of this data.

Our data protection statement informs you, in particular, about the type, scope, purpose, duration and legal basis for processing personal data, inasmuch as we come to a decision either alone or in liaison with other parties about the purposes and processing means. In addition, we set out below the third-party components we use to optimise processing and to increase the quality of use, insofar as third parties process data subject to their own responsibility.

II. Users’ and data subjects’ rights

In view of the data processing described in more detail below, users and data subjects have the right:

  • to confirmation as to whether relevant data is being processed, to information about which data is being processed, to further information about data processing and to copies of the data (cf. also Art. 15 GDPR);

  • to rectify or to complete data that is either incorrect or incomplete (cf. also Art. 16 GDPR);

  • to the immediate deletion of the data held on them (cf. also Art. 17 GDPR), or, alternatively, if further processing is required in accordance with Art. 17, para. 3 GDPR, restriction of processing in accordance with Art. 18 GDPR;

  • to receive the data concerning them and that they have provided, and to transfer this data to other vendors / responsible parties (cf. also Art. 20 GDPR);

  • to complain to the regulator if they feel their data is being used in contravention of the data protection regulations (cf. also Art. 77 GDPR).

In addition, the vendor must notify all recipients to whom data has been disclosed by the vendor of any correction or deletion of data or the restriction of processing occurring in accordance with Arts. 16, 17, paras. 1, 18 GDPR. However, this does not apply where notification is either not possible or is disproportionate. Regardless of this, the user has the right to information about these recipients.

In accordance with Art. 21 GDPR, insofar as data is provided by a vendor in accordance with Art. 6 para. 1 (f) GDPR, users and data subjects are also entitled to object to future processing of their data. In particular, you can object to the use of data for direct advertising purposes.

III. Data processing

Your data that we process when you visit our website will be either deleted or blocked as soon as we have no reason to store it, provided that data deletion does not conflict with any statutory retention requirements and no other information on individual processing methods is given below.

For technical reasons, particularly in order to ensure secure and stable access to our website, data is transmitted to us or to our web space provider via your internet browser. The server log files produced in this way provide, among other things, for a record of your internet browser and the version you are running, the operating system, the referrer URL, namely the website via which you came to our website, which of our websites you are visiting, the date and time of the respective access and the IP address of the internet connection from which you accessed our website.

We store the data we collect from you temporarily, nevertheless this data is kept separate from your other data.

We store data in accordance with Art. 6, para. 1 (f) GDPR. Please note that we have a legitimate interest in improving our website, and in its stability, functionality and security.

We will delete your data 7 days after collecting it, at the latest, inasmuch as we do not need to store it for use as evidence. In such a case, data is either partially or fully kept until the given issue is finally resolved.

Cookies

a) Session cookies

We use cookies on our website. These are small text files or other data storage means that are recorded on your device by your internet browser. Regarding yourself, the cookies process certain information about you, such as your browser, location or IP address.  

In this way, we make our website more user-friendly, more effective and also more secure, since the processing enables, for example, our website to be displayed in various languages, or for intended purchases to be place in a cart.

Insofar as cookies are used to set up or to implement a contract, cookies are processed in accordance with Art. 6, para. 1 (b) GDPR.

Insofar as processing is not for purposes of setting up or executing a contract, our data processing occurs in line with Art. 6, para. 1 (f) GDPR.

Session cookies are deleted when you close your internet browser.

b) Third-party cookies

Where applicable, our website also uses cookies from partner companies we work with for advertising or analysis purposes, or for the functioning of our website.

Please see below for further information on this, particularly regarding the purpose and legal basis for processing such third-party cookies.

c) Cookie restriction or removal

You are entitled to either restrict or prevent cookies from being deployed on your internet browser. You can also delete cookies that have already been saved at any time. Inasmuch as you contact us using the contact form or by email, the data you provide will be used in processing your request. You will need to provide the data in order for your request to be dealt with, otherwise we will, at least in part, not be able to respond to your request.

We process data in this respect in accordance with Art. 6, para. 1 (b) GDPR.

If your request has been fully dealt with, your data will be deleted, provided that there are no legal reasons why the data should continue to be stored, such as in subsequently implementing a contract.

Google Analytics

We use Google Analytics on our website. This is a web analysis service provided by Google LLC, of 1600 Amphitheater Parkway, Mountain View, CA 94043 USA, referred to below as “Google”.

Through certification held in accordance with the EU-US Privacy Shield, Google is able to guarantee that the EU's data protection requirements will also be met when processing data in the USA.

We use Google Analytics to analyse the pattern of your visits to our website. This occurs in accordance with Art. 6, para. 1 (f) GDPR. We have a legitimate interest in analysing and improving our website, and in running it on an economical basis.

Usage and user-related information, such as the IP address, location, time or frequency of visits to our website, are transmitted to a Google server in the USA and stored there. Whatever, your data is anonymised in connection with Google Analytics.  This means that Google shortens your IP address within the EU or EEA.

The data collected in this way is in turn used by Google to provide us with an evaluation of your access to our website and your use of it. The data can also be used to provide other services in connection with use of our website and the Internet.

Google also offers a deactivation add-on, together with further information. We offer you the opportunity to apply to us via our website. As part of an online application, we collect your applicant data, and use it as part of electronic, applicant processing.

We do this in accordance with s. 26, para. 1, sentence 1 GDPR, in conjunction with Art. 88, para. 1 GDPR.

If we agree an employment contract following the application process, we will save your data in your personnel file, for standard organisational and administrative purposes, in due compliance with further legal obligations.

This is also carried out in accordance s. 26, para. 1, sentence 1 GDPR in conjunction with Art. 88 para. 1 GDPR.

If your application is not accepted, we automatically delete the data transmitted to us two months after notification of the rejection. However, we will store your data for a period of up to a further four months or longer where legal requirements make this necessary, for example, should we need to provide evidence under the German Equal Treatment Act (AGG).

Art. 6, para. 1 (f) GDPR and s. 24, para. 1, sub-sec. 2 GDPR form the legal basis for this. Our legitimate interest here lies in being able to mount a legal defence or to enforce an agreement.

Insofar as you expressly agree to your data being stored for a longer period of time, e.g. to apply for further jobs or for other interest in our company, your data will be further processed accordingly. This is in accordance with Art. 6, para. 1 (a) GDPR. You can of course withdraw your consent at any time, in accordance with Art. 7, para. 3 GDPR, declaring this to us, with effect from that time onwards.

Use of the OnWebChat live chat system

This website uses technology from OnWebChat, Sfaktion 36, 73134 Chania, Greece (https://www.onwebchat.com) to pseudonymise data collected and stored for the purpose of web analysis and to run the live chat system to answer live support inquiries. Usage profiles can then be created from this pseudonymised data under a pseudonym. To this end, cookies may be used. Where the information gathered in this way shows a reference to persons, processing occurs in accordance with Art. 6, para. 1 (f) GDPR, in line with our legitimate interest in effective customer service and in analysing user behaviour to optimise our website.
Data collected using OnWebChat software will not be used to personally identify the visitor to this website and will not be merged with personal data about the bearer of the pseudonym, without the separate consent of the person concerned. To avoid storage of OnWebChat cookies, you can set your internet browser so that cookies are no longer stored on your computer, or such that cookies already stored there are deleted.
